Privacy Policy

Beghou Consulting, Inc. (“us”, “we”, or “our”) operates the Mainsail™ website (“Site”) and the Mainsail™ mobile application (“App”) which provide computerized platforms for data collection and reporting. Your use of the Site and App is collectively referred to as the “Service.”

This page informs you of our policies regarding the types of information we may collect from you or that you may provide when visiting the Site or using the App, and our practices for collection, use and disclosure of that data when you use our Service, and the choices and options you have with respect to how that data is used.

This policy applies only to information we collect from you via the Site or the App, including email, text, and other electronic communications sent through or in connection with the Site or App.

This policy DOES NOT apply to:
(1) information that we collect offline or on any other of our apps or websites, including websites you may access through the Site or the App; or
(2) information that you provide to or is collected by any third party.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use the App and do not use the Site. By clicking on the acceptance box at the end of this privacy policy and accessing or using the Site or by downloading, installing or using the App, you agree to the terms of this privacy policy. This policy may change from time to time. Your continued use of the App, Site and the Service after we revise this policy means you accept those changes, so please check the policy periodically for updates.

 

Definitions

Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Mainsail™ Software as a Service Agreement or other Terms and Conditions.

Service

Service means the Mainsail™ website and the Mainsail™ mobile application operated by Beghou Consulting, Inc.

Personal Data
Personal Data means information about a living individual, such as name, postal address, email address, telephone number, cookies, any other information which we collect which is defined as personal information or personally identifiable information under an applicable law, or any other identifier by which a person may be contacted online or offline (or other information either in our possession or likely to come into our possession). Personal Data may be entered when registering for the Service, when you communicate with us or when using the App or Site.

Usage Data
Usage Data is information that your browser sends whenever you visit our Site or when you access the Service by or through a mobile device (“Usage Data”). Usage Data can be collected automatically, generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Cookies
Cookies are files with small amounts of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and are stored on your computer or mobile device.

Data Controller
Data Controller means the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any Personal Data are, or are to be, processed.
For the purpose of this Privacy Policy, we are a Data Controller of your Personal Data.

Data Processors (or Service Providers)
Data Processor (or Service Provider) means any natural or legal person who processes the data on behalf of the Data Controller.
We may use the services of various Service Providers in order to process your data more effectively.

Data Subject (or User)
Data Subject is any living individual who is using our Service and is the subject of Personal Data.

User Contributions
Users of the Service may provide information for publication or display (”Posted”) on public areas of websites which the User accesses through the App or Site (collectively, “User Contributions”).

 

Information We Collect and How We Collect It

We collect, store and remember several different types of information to provide and improve our Service to you.

Types of Data Collected

Personal Data

While using our Service, we may use and store your Personal Data to improve the Service. We will not use your Personal Data to contact you with newsletters, marketing or promotional materials.

Usage Data
We may also collect Usage Data, which may include information such as your computer’s Internet Protocol address (IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When you access the Service with a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.

Location Data
We may use and store information about your location if you give us permission to do so (“Location Data”). We use this data to provide features of our Service, to improve and customize our Service.

You can enable or disable location services when you use our Service at any time by way of your device settings.

Tracking Cookies Data
We use cookies and similar tracking technologies to track the activity on our Service.

We retain information gathered by cookies in order to improve our Service.  We also use other tracking technologies such as beacons, tags and scripts (which work similarly to cookies) to collect and track information and to improve and analyze our Service.

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you will not be able to use some portions of our Service.

  • Session Cookies. We use Session Cookies to operate our Service.
  • Preference Cookies. We use Preference Cookies to remember your preferences and various settings.

Use of Data

Beghou Consulting, Inc. uses the collected data for various purposes:

  • To provide and maintain our Service and its contents to you
  • To provide you with information, products or services that you request from us
  • To enable greater functionality of the Service
  • To notify you about changes or updates to our Service
  • To allow you to participate in interactive features of our Service when you choose to do so
  • To provide customer support
  • To analyze usage and data so that we can improve our Service
  • To monitor the usage of our Service
  • To detect, prevent and address technical issues
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us

Legal Basis and Purpose for Collecting and Processing Personal Data under the General Data Protection Regulation (GDPR)
If you are from the European Economic Area (EEA), Beghou Consulting, Inc.’s legal basis for collecting and using the Personal Data described in this Privacy Policy depends on the Personal Data w
e collect and the specific context in which we collect it.

Processing your Personal Data is necessary for our performance under our contract with you for your use of the Service. The Personal Data we use consists of information you give to us pursuant to your contract with us, and includes the following groups and types of information: your username, date and time, IP address, the name of the device you use, HTTP cookies, and records entered by you when you take actions while using the App or Site. The Personal Data we use is limited to what we need to provide you with the Service.

We cannot provide the Service to you without your Personal Data. Accordingly, we have a legitimate business interest in your Personal Data, which is not overridden by your rights.

In addition to your Personal Data, we also use and process certain other data entered by users of the Service or health care providers, which may include: health care provider profile information, sales call activity logging (including length of visit and details of visit), account profile information, relationships between accounts and health care providers.

We do not use automated decision-making in connection with collecting or processing Personal Data.

Retention of Data
Beghou Consulting, Inc. will retain your Personal Data for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations and retention policy (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.

Beghou Consulting, Inc. will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer periods.

Unless compliance with applicable laws requires longer retention, Beghou Consulting, Inc. will retain your Personal Data for no more than 26 months.

Transfer of Data
Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

If you are located outside United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to United States and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Beghou Consulting, Inc. will take all the steps reasonably necessary to ensure that your Personal Data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

 

Disclosure of Data / Recipients of Data

Aggregate Data
We may disclose aggregated information about our users to third parties as long as such information does not identify any individual or device, without restriction.

In addition, we may disclose Personal Data under the following circumstances:

Contractors/Vendors
We may disclose your Personal Data to contractors, service providers, and other third parties we use to support our business, and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

Business Transaction
If Beghou Consulting, Inc. is involved in a merger, acquisition or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.

Compliance with Law
Under certain circumstances, Beghou Consulting, Inc. may disclose your Personal Data to comply with any court order, law, or legal process, including to respond to any government or regulatory request.

We may disclose your Personal Data with your consent.

Beghou Consulting, Inc. may disclose your Personal Data in the good faith belief that such action is necessary or appropriate to:

  • To protect and defend the rights, property or personal safety of Beghou Consulting, Inc., our customers and others

 

Security of Data

We have implemented measures designed to secure your Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. In instances in which we have given you (or where you have chosen) a password for access to certain parts of our App or Site, you are responsible for keeping this password secure and confidential. We ask you not to share your password with anyone.

The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security. Any transmission of Personal Data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

Your Data Protection Rights under the General Data Protection Regulation (GDPR)

If you are a resident of the European Economic Area (EEA), you have certain data protection rights. Beghou Consulting, Inc. aims to take reasonable steps to allow you to correct, amend, delete or limit the use of your Personal Data.

If you wish to be informed about what Personal Data we hold about you and if you want it to be removed from our systems, please contact us.

In certain circumstances, you have the following data protection rights:

  • The right to access, update or delete the information we have on you. Whenever made possible, you can access, update or request deletion of your Personal Data directly within your account settings section. If you are unable to perform these actions yourself, please contact us to assist you. 
  • The right of rectification. You have the right to have your information corrected if that information is inaccurate. You have the right to complete any incomplete data, including by way of supplementing a corrective statement.
  • The right to object. You have the right to object to our processing of your Personal Data by sending an email to privacy@beghouconsulting.com
  • The right of restriction. You have the right to request that we restrict processing your Personal Data, in which case we will store but not process your Personal Data.
  • The right to data portability. You have the right to be provided with a copy of the information we have on you in a structured, machine-readable and commonly used format, which permits your further use. Alternatively, you may instruct us to transmit your Personal Data directly to another party.

Your Choices About Our Collection and Use of Your Information

We strive to provide you with choices regarding the Personal Data you provide to us. This section describes mechanisms we provide for you to control certain uses over how, when and where we collect your information.
Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent.  If you disable or refuse cookies or block the use of other tracking technologies, the App may not be fully accessible and will not function properly.

Location Information. You can choose whether or not to allow the App to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some parts of the App may then be inaccessible or not function properly.

You may opt out of receiving any communications from us by contacting us.

Accessing and Correcting Your Information

You can review and change your Personal Data by logging into the App or Site and visiting your account profile page. You may also send us an email at privacy@beghouconsulting.com to request access to, correct or delete any Personal Data that you have provided to us. We cannot delete your Personal Data except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Site, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website users. Proper access and use of information provided on the Site including User Contributions, is governed by our terms of use.

Your California Privacy Rights

Our Policy on “Do Not Track” Signals under the California Online Protection Act (CalOPPA)
We do not support Do Not Track (“DNT”). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

Service Providers

We may employ third party companies and individuals to facilitate our Service (“Service Providers”), provide the Service on our behalf, perform Service-related services or assist us in analysing how our Service is used.
These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Analytics
We may use third-party Service Providers to monitor and analyse the use of our Service based on our instructions and in compliance with our Privacy Policy and any other appropriate confidentiality and security measures.

Google Analytics
Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses non-personally identifiable, anonymized data collected by us to track and monitor the use of our Service. This non-personally identifiable, anonymized data is shared with other Google services.

Our Service may contain links to other sites that are not operated by us. If you click a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

User Contributions and Posts
User Contributions are Posted and transmitted to others at the User’s own risk. Although User may set certain privacy settings for such information by logging into User’s account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Children’s Privacy
Our Service does not address anyone under the age of 18 (“Child”, Children”). If you are under the age of 18, do not use the Service or provide any information to the Site or App.

We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from Children without verification of parental consent, we take steps to remove that information from our servers.

Changes to This Privacy Policy
We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.

We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the “effective date” at the top of this Privacy Policy.
